Welcome to Stephanie Albertson Jewelry LLC ("we”, “us”, “our”).

These Terms of Service ("Terms") govern your access to and use of our website located at www.stephaniealbertson.com and our mobile app (collectively, the "Site"), together with all information, content, features, products and services we offer through the Site. By using this Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site.

Section 1. Intellectual Property and Trademarks

As between you and Stephanie Albertson Jewelry LLC, Stephanie Albertson Jewelry LLC is the owner and/or authorized user of any registered or unregistered trademark, trade name, and/or service mark appearing on the Site, and is the copyright owner or licensee of all materials and content on the Site, unless otherwise indicated.

The Jewels For Home™ mark, logo, designs, products, product names, Stephanie Albertson Jewelry LLC logos, jewelry designs, product names, packaging designs, promotional materials, website design elements, and the copyrights, trademarks, service marks, trade dress, and/or other intellectual property in such materials (collectively, “Stephanie Albertson Jewelry Intellectual Property") are owned by Stephanie Albertson Jewelry LLC and may be registered in the United States and internationally.

You agree not to display, reproduce, or use Stephanie Albertson Jewelry LLC Intellectual Property in any manner without our prior written permission. Nothing on the Site should be construed to grant any license or right to use any Stephanie Albertson Jewelry LLC Intellectual Property without our prior written consent.

Use of the Site does not grant you a license to any materials, content, jewelry designs, or features you may access on the Site, and you may not modify, rent, lease, loan, sell, distribute, or create derivative works of such materials, content, designs, or features, in whole or in part. Any commercial use of the Site is strictly prohibited, except as otherwise approved by us.

All information on the Site, including jewelry designs, product photography, site design, text, graphics, user interfaces, logos, and the selection and arrangement thereof, is protected by intellectual property law, including copyright and trademark law.

All products are original designs exclusive to Stephanie Albertson Jewelry LLC.

Section 2. Orders, Payments, and Processing

All orders are subject to product availability, inventory confirmation, and our acceptance. We reserve the right to cancel, refuse, or limit any order for any reason, including but not limited to pricing errors, product unavailability, suspected fraudulent activity, or failure to meet our verification requirements.

Pricing and Availability: Prices and product offerings are subject to change without prior notice. All prices are listed in U.S. dollars and do not include applicable taxes, duties, or shipping charges unless otherwise specified. For custom and bespoke jewelry, final pricing will be confirmed before production begins.

Payment Terms: Payment is due in full at the time of order placement via the accepted payment methods displayed at checkout. We accept major credit cards, debit cards, and other payment methods as available. All payments are processed in U.S. dollars.

Payment Processing: Payment transactions are processed through third-party payment processors, which maintain separate terms of service and privacy policies. By using our Site, you agree to comply with the applicable terms of our payment processors. We are not responsible for any issues arising from payment processor services, including but not limited to transaction failures, processing delays, or data security matters handled by these third parties.

Order Confirmation: Orders are not confirmed until you receive an email confirmation from us. We may contact you to verify order details, payment information, or shipping addresses before processing.

High-Value Transactions: Orders exceeding specified dollar amounts may require additional verification steps, including identity confirmation or alternative payment arrangements.

Section 3. Returns and Exchanges

Return Notification Requirement: If you wish to return any item, you must notify us within three (3) business days after receipt of the item by contacting us at studio@stephaniealbertson.com or 917-279-0804.

No returns will be accepted without prior written confirmation from our company.

Return Remedy: If we approve your return request, you will receive a non-expiring store credit in the amount of the purchase price for the returned item (but excluding any amounts with respect to shipping) that may be applied to future purchases Stephanie Albertson Jewelry LLC. No cash refunds will be provided.

Return Conditions: All returned items must be:

Unaltered, unworn, and in original saleable condition

Accompanied by original packaging and all tags

Shipped prepaid and insured by customer

Risk of Loss: Customer bears all risk of loss or damage during return shipping until the item is actually received by our company. We recommend using a trackable shipping method with insurance for your protection.

Return Exclusions:

We will not accept returns of:

Custom or personalized jewelry

Items damaged by customer use, neglect, or normal wear and tear

Items returned without prior written authorization

Items not purchased directly from us

Section 4. Use of Site

You agree to use the Site lawfully, respectfully, and in accordance with these Terms. You represent that you have the legal capacity to enter into this agreement and that all information you provide is accurate and complete.

Prohibited Activities:

You may not:

Use the Site or its content for any unlawful, fraudulent, or unauthorized purpose

Copy, scrape, harvest, or extract content, including jewelry designs, product images, or pricing information

Reproduce, distribute, or create derivative works from our proprietary designs or materials

Attempt to breach Site security, bypass access controls, or interfere with Site operation

Use automated tools, bots, or scripts to access or interact with the Site

Upload, transmit, or distribute any harmful code, viruses, or malicious software

Impersonate others or provide false information during account creation or checkout

Engage in any activity that could damage, disable, or impair the Site's functionality

Use the Site to compete with our business or create competing jewelry designs

Violate any applicable local, state, national, or international law or regulation

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Monitoring and Enforcement: We reserve the right to monitor Site usage and investigate suspected violations. We may, in our sole discretion, suspend or terminate your access, remove content, and pursue legal remedies for violations of these Terms.

Consequences of Violation: Violation of these rules may result in immediate termination of Site access, removal of content, legal action for damages, and reporting to appropriate authorities where applicable.

Section 5. Brand Collaborations & Influencer Usage

We welcome partnerships with like-minded brands and creators, but the use of our brand elements requires written consent. This includes:

Logos, imagery, and video content

Jewelry or lifestyle product photography

Brand names such as Stephanie Albertson Jewelry LLC and Jewels For Home™.

If You Are a collaborator or influencer, you must:

Obtain written approval before using our IP in content

Adhere to FTC guidelines and disclose sponsorships or gifts

Tag and mention our brand using approved handles and hashtags only

Avoid altering or misrepresenting our brand identity

Unapproved use of our intellectual property may result in legal action.

Section 6. Limited Lifetime Warranty

Limited Lifetime Manufacturing Warranty: We warrant that all jewelry will be free from defects in craftsmanship and assembly for the life of the product when used under normal conditions.

Material Quality: Our jewelry is crafted using genuine precious metals and natural gemstones. Natural variations in gemstones, including inclusions, color variations, and surface characteristics, are inherent properties and not defects.

Warranty Exclusions:

This warranty does not cover:

Natural characteristics of precious metals and gemstones

Damage from neglect, abuse, accidents, or improper care

Normal wear including surface scratches, patina development, or metal fatigue over time

Damage from exposure to chemicals, extreme temperatures, or impact

Repairs, modifications, or sizing performed by other jewelers

Damage to stones from any cause

Loss of the product or any component of a product, including stones

Exclusive Remedy: Your sole and exclusive remedy under this warranty is repair or replacement of the defective item, at our sole discretion. We will not provide refunds, store credit, or any other form of compensation under this warranty.

Insurance Recommendation: We strongly recommend purchasing insurance to cover the excluded risks, including damage to stones and loss of your jewelry or its components.

Warranty Claims: To make a warranty claim, contact us with proof of purchase and detailed description of the defect.

Warranty Transfer: This warranty is non-transferable and applies only to the original purchaser.

EXCEPT AS EXPRESSLY SET FORTH ABOVE, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO OUR PRODUCTS AND THIS SITE.

Section 7. Limitation of Liability and Emotional Damage Waiver

To the fullest extent allowed by law, Stephanie Albertson Jewelry LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Site or purchase of products.

EMOTIONAL DAMAGE WAIVER: YOU EXPRESSLY WAIVE ANY CLAIM FOR EMOTIONAL DISTRESS, MENTAL ANGUISH, SENTIMENTAL VALUE, OR OTHER INTANGIBLE DAMAGES RELATED TO ANY PRODUCT, SERVICE, OR TRANSACTION WITH US. THIS INCLUDES BUT IS NOT LIMITED TO CLAIMS RELATED TO DAMAGED, LOST, OR DELAYED JEWELRY ITEMS, REGARDLESS OF THEIR PERSONAL OR SENTIMENTAL SIGNIFICANCE TO YOU.

Any claim or cause of action you may have with respect to the Site or any purchase of products must be commenced within one (1) year after the claim or cause of action arose.

Section 8. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Mandatory Arbitration: Any controversy or claim arising out of or relating to these Terms, your use of the Site, any purchase of products or services, or the breach of these Terms, shall be settled by arbitration before a single arbitrator in Orlando, Florida, administered by the American Arbitration Association under its Commercial Arbitration Rules, including its Expedited Procedures, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Exceptions: This arbitration provision does not apply to claims for injunctive relief to protect intellectual property rights.

Section 9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page and your continued use of the Site constitutes your acceptance of those changes.
